Introduction
Sky Fitness LLC (“Sky Fitness,” “we,” “us,” or “our”) is a fitness business based in New York, USA. We are committed to protecting your privacy. This Privacy Policy explains what personal information we collect, how we use and share it, and your rights regarding that information. It applies to information we collect through our website (including via Wix Forms), our virtual and in-person calisthenics training services, and any related communications (collectively, the “Services”). By using our Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services or provide us with your personal information.

1. Information We Collect

We collect personal information that you voluntarily provide to us, as well as some information automatically when you use our website or Services.

  • Information You Provide: When you interact with Sky Fitness (for example, by filling out forms on our Wix-powered website, signing up for training sessions, or contacting us), you may give us personal information such as:

    • Contact Information: Name, email address, telephone number, and mailing address.

    • Account and Inquiry Information: Information you provide in messages or inquiries (e.g. fitness goals or preferences) and any account credentials if an account is created.

    • Payment Information: Billing details such as credit card number or other payment data when purchasing our training services. Note: Payment information submitted through our site (e.g. via Wix Forms or QuickBooks invoicing links) is collected securely. We do not store full credit card numbers on our servers; payments may be processed by third-party services like QuickBooks (Intuit) or Wix’s payment processor, which handle your payment data in compliance with industry security standards.

  • Information We Collect Automatically: When you visit our website, we use cookies and similar tracking technologies (like those provided by Google Analytics) to collect certain technical information automatically. This may include:

    • Usage and Device Data: IP address, browser type, device identifiers, pages viewed, dates/times of visits, and referring page.

    • Cookies and Tracking: Cookies are small text files placed on your device that help us recognize you and gather analytics data about your interaction with our site. See Cookies and Analytics below for more details.
      This automatically collected data is generally used in aggregate form to analyze traffic and usage of our site, and typically does not directly identify you by name. However, it may be associated with your account or contact information if you have provided that to us.

 

2. How We Use Your Information

Sky Fitness uses the collected information for the following purposes:

  • To Provide and Personalize Services: We use your information to deliver our fitness training services, schedule sessions (virtual or in-person), tailor workouts or content to your needs, and generally manage your relationship with us as a client.

  • To Process Payments and Transactions: We use contact and payment information to bill you for our services, process payments (through secure third-party processors like QuickBooks), and maintain proper financial records.

  • To Communicate with You: We may use your email or phone number to send you service-related announcements, respond to your questions or requests, provide customer support, and remind you of upcoming sessions. With your consent, we may also send occasional newsletters or promotional communications about new classes, events, or offers. You can opt out of marketing emails at any time by using the unsubscribe link or contacting us directly.

  • For Analytics and Improvements: Information gathered (including via Google Analytics cookies) helps us understand how our website is used. We analyze this data to improve our site design, content, and services. For example, tracking which pages are most visited can inform us what content is most useful to clients.

  • To Ensure Security and Prevent Fraud: We may use data to protect our website, business, and users from fraud, abuse, or unauthorized access. This includes monitoring for suspicious activity and enforcing our Terms of Use.

  • To Comply with Legal Obligations: In certain cases we need to process or retain your information to fulfill laws and regulations (for example, keeping transaction records for tax filings, or responding to lawful requests by public authorities). We may also use or disclose information to exercise or defend legal claims.

  • With Your Consent: If we want to use your personal information for a purpose not described above, we will ask for your consent. For instance, if we wish to feature your testimonial or progress photo on our website or social media, we would obtain your permission before doing so.

We will only use your personal information in ways that are compatible with the purposes for which it was collected or that you have otherwise authorized. We do not use personal data for any automated decision-making or profiling that produces legal effects concerning you.

3. How We Share or Disclose Information

Sky Fitness respects your privacy – we do not sell your personal information to third parties. We only share your information in limited circumstances, as described below:

  • Service Providers: We share information with trusted third-party service providers who perform functions on our behalf to support our business. This includes:

    • Wix.com: Our website is hosted on the Wix platform. Information you submit through website forms (your name, contact info, etc.) is stored on Wix’s secure servers. Wix may technically have access to this data as our website provider, but they are obligated not to use it except to support our website functionality.

    • Payment Processors (QuickBooks/Intuit): When you make a payment, your payment details are processed by QuickBooks (operated by Intuit) or another secure payment gateway. These third parties specialize in payment processing and will use your payment data only to process the transaction and related activities (like fraud screening or sending you a receipt).

    • Analytics Providers (Google Analytics): We use Google Analytics to gather usage data as noted. Google acts as a processor of usage data; they may have access to data about your device and browsing on our site. This information is generally aggregated and not personally identifying. (See Cookies and Analytics below for how Google Analytics works and how you can opt out.)

    • Other Vendors: We may rely on other vendors for services like email newsletter distribution, scheduling or videoconferencing platforms (for virtual training sessions), or IT support. These providers would receive only the information necessary to perform their functions (for example, your email address for an email service, or your name and email to send you a Zoom class invite), and they are contractually required to protect your data and use it only for our specified purposes.

  • Business Transfers: If Sky Fitness LLC is involved in a merger, acquisition, asset sale, or other business reorganization, customer information (including personal data) might be transferred to the successor or new owner as part of that transaction. In such an event, we will ensure that your information remains protected and will provide notice on our website and/or contact you if required by law before any personal information is transferred or becomes subject to a different privacy policy.

  • Legal Compliance and Protection: We may disclose your information if we in good faith believe such action is necessary to: (a) comply with a legal obligation, law or court order; (b) respond to lawful requests by public authorities (including to meet national security or law enforcement requirements); (c) enforce our Terms of Use or other agreements; (d) protect the rights, property, or safety of Sky Fitness, our customers, or others. This includes exchanging information with other companies and organizations for fraud prevention or credit risk reduction.

  • With Your Consent: Aside from the cases above, if we intend to share your personal information with third parties (for example, publishing a client success story or partnering with another fitness professional for a program), we will notify you and obtain your consent as needed.

When we share data with service providers, they are given only the information necessary to perform the required service. We require these providers to keep your information confidential and secure and to use it only for the purposes we specify.

4. Cookies and Analytics

Cookies: Sky Fitness uses cookies and similar technologies on our website to improve user experience and analyze website traffic. Cookies are small text files placed on your computer or device when you visit a website. They help the site function properly and remember your preferences (for example, recognizing you if you’ve visited before). We use cookies for purposes such as:

  • Essential Cookies: Some cookies are necessary for the website to operate (for example, those used by Wix for core site functionality and security). Without these, the site may not function correctly.

  • Analytics Cookies: We use Google Analytics, a web analytics service provided by Google, Inc., which sets its own cookies. These cookies collect information about how visitors use our site, including how you arrived at our site, which pages you visit, how long you stay, and what you click on. We use this information to understand user behavior and improve our website. The data collected via Google Analytics is anonymous to us (we cannot directly identify you) and is used in aggregate form.

Google Analytics: Google Analytics uses first-party cookies (e.g., the Google Analytics cookie) to track user interactions. Google may also use other identifiers and data for analytics purposes. We have enabled basic analytics to help us gauge the effectiveness of our site content and marketing. We do not use Google Analytics Advertising Features (such as remarketing or demographic reporting) at this time.

  • How to Opt-Out of Analytics: If you prefer to prevent Google Analytics from collecting data when you visit our site, you can install the Google Analytics Opt-out Browser Add-on in your web browser. You can also adjust your browser settings to refuse cookies or alert you when cookies are being sent. Please note that if you disable cookies, certain features of our website may not function as intended.

We display a cookie notice or banner on our site (in jurisdictions where required) to inform you of our use of cookies when you first visit. 5. Data Security

We take the security of your personal information seriously. Sky Fitness implements reasonable administrative, technical, and physical safeguards to protect your data from unauthorized access, disclosure, alteration, and destruction. These measures include, for example:

  • Encryption: Our website is secured via SSL (Secure Sockets Layer). This means that information you submit (such as through forms or payment pages) is encrypted in transit to prevent eavesdropping. When we use third-party services like QuickBooks for payment, those services also use encryption and secure protocols to protect your financial information.

  • Access Controls: Internally, we limit access to personal information to those employees, contractors, or agents who need it to perform their job duties (for instance, our trainers and administrative staff who handle scheduling and billing). They are bound by confidentiality obligations.

  • Security Practices: We maintain up-to-date security software and monitoring to detect and prevent unauthorized system access. We also rely on Wix’s and Intuit’s security features for the parts of your data stored on those platforms (both companies employ industry-leading security measures).

  • Training and Policies: We educate our staff on privacy and security best practices and have internal policies to safeguard data (for example, requiring strong passwords and two-factor authentication where available, and not sharing client information via insecure channels).

While we strive to protect your information, please note that no method of transmission over the internet or electronic storage is 100% secure. Therefore, we cannot guarantee absolute security of your data. You share information with us at your own risk. In the unlikely event of a data breach that affects your personal information, we will notify you and the appropriate authorities promptly, as required by applicable law (including New York State’s data breach notification laws), and will take all reasonable steps to mitigate any potential harm.

6. Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. For example:

  • Contact and account information will be kept for as long as you are an active client or have an ongoing relationship with us. If you discontinue services, we may retain certain information for a period in case you return or to maintain records of our interactions.

  • Payment and transaction records will be retained as needed for financial auditing and tax compliance (often a minimum of several years, as required by law). We do not keep full credit card numbers on file after processing, but basic transaction logs are kept for accounting.

  • Analytics data collected via cookies is stored by Google Analytics; we review aggregate analytics, but we do not store that raw analytics data ourselves beyond what Google provides in reports. Google Analytics retains data for a period (e.g., 14 months) as configured in our account, after which it is deleted automatically.

  • If you have consented to marketing communications, we will retain your contact information until you opt out or unsubscribe, or until we no longer send communications. We promptly honor opt-out requests and will remove your contact from our marketing list, though we may keep a record of your request to ensure we respect it in the future.

When we no longer have a legitimate need to retain your personal data, we will securely delete or anonymize it. For example, we may shred paper forms, permanently erase electronic files, or disassociate data from personal identifiers so it can no longer be linked to you.

7. Your Rights and Choices

You have certain rights and choices regarding your personal information. Sky Fitness aims to be transparent and give you control over your data. Subject to applicable law, your rights may include:

  • Access and Correction: You may request access to the personal information we hold about you and ask that we correct or update any inaccuracies. For instance, if you believe we have an incorrect email address or outdated contact info, you can ask us to fix it.

  • Deletion (Right to Erasure): You may request that we delete your personal information. Upon a verified request, we will delete or anonymize the personal data we have about you, except to the extent we are required to keep it for legal reasons (for example, we might retain transactional records for accounting, or keep information needed to exercise or defend legal claims).

  • Withdrawal of Consent: If we are processing your information based on your consent (for example, you consented to receive marketing emails or you allowed your minor child to participate in our program), you have the right to withdraw that consent at any time. Withdrawal of consent will not affect the lawfulness of any processing done before you withdrew consent, and it may mean we can no longer provide you certain services (for example, if you withdraw consent for your child’s participation, we will cease training services for them).

  • Opting Out of Communications: If you no longer wish to receive marketing or promotional communications from us, you can opt out at any time. Simply click the “unsubscribe” link in any marketing email or contact us at our email address below with your request. Note that we may still send you essential service or transactional messages (such as appointment reminders or billing notices) even if you opt out of marketing.

  • Parental Rights for Minors: If you are a parent or legal guardian who has consented to your minor child using our Services, you have the right to review the personal information we have collected about your child, request its deletion, and refuse further collection or use of the child’s information. We will seek parental verification for such requests to ensure that you are the child’s guardian. (See Children’s Privacy below for more.)

  • California Privacy Rights: Although Sky Fitness primarily operates in New York, if you are a California resident you may have additional rights under the California Consumer Privacy Act (CCPA) or other laws, such as the right to request information about personal data we have collected or disclosed. We do not sell personal information. If you are a California resident and wish to exercise any privacy rights under California law, please contact us — we will treat your request in accordance with applicable law.

Exercising Your Rights: To exercise any of the rights above, please contact us using the information in the Contact Us section of this Policy. We may need to verify your identity (and/or authority, if you are a parent making a request on behalf of a minor) before fulfilling the request, for security. Verification may include confirming ownership of the email associated with your data or asking for additional information. We will respond to your request within a reasonable timeframe as required by law.

Please note that some rights may not apply in all cases. For example, certain data may be exempt from deletion requests if it is needed for legal compliance. If we cannot comply with a request, we will provide an explanation subject to legal restrictions.

8. Children’s Privacy

Protecting the privacy of minors is especially important. Our website and Services are not directed to children under the age of 13. We do not knowingly collect personal information from anyone under 13 years old without verifiable parental consent. If you are under 13, do not submit any information on our website or use our Services without your parent or guardian’s permission.

For minors aged 13 to 17, participation in our calisthenics training services is only allowed with the involvement and consent of a parent or legal guardian. Any personal information related to a minor client (such as the minor’s name, age, and relevant contact or health information) should be provided to us by the parent or guardian, or with their full knowledge and consent. We require verifiable parental consent before collecting or using personal data of minors under 18 for our Services.

If we become aware that we have inadvertently collected personal information from a child under 13 without parental consent, we will take immediate steps to delete that information from our records. Similarly, if a minor under 18 has provided us information without a parent/guardian’s consent, we will deactivate the account or expunge the data once we are alerted.

Parents/Guardians: If you believe that we have collected personal information from your child without proper consent or if you wish to review or delete information about your child, please contact us. We will work with you to promptly address any issues and honor your requests as required by law. We encourage parents and guardians to actively supervise and monitor their children’s online activities and fitness participation.

9. Third-Party Links and Services

Our website or communications may contain links to third-party websites or services (for example, social media pages like Instagram/Facebook, or perhaps recommended equipment retailers, etc.). Please note that this Privacy Policy does not apply to information collected by those third-party websites. If you click on a link to a third-party site, you will be directed to that third party’s website, which will have its own privacy policy. We have no control over and are not responsible for the content, privacy practices, or operations of any third-party sites or services. We recommend that you review the privacy policies of any third-party sites you visit.

Additionally, if we offer any integrations with third-party platforms (for instance, using Zoom for virtual classes, or processing payments via Intuit QuickBooks), your information may be collected or used by those third parties in accordance with their own privacy policies. We strive to choose reputable partners and will outline relevant third-party involvement in this Policy (as we have with Wix, Google, and QuickBooks), but we encourage you to familiarize yourself with those entities’ policies as well.

10. Changes to This Privacy Policy

We may update or modify this Privacy Policy from time to time to reflect changes in our practices, operational needs, or for legal reasons. When we make changes, we will update the “Effective Date” at the top of the Policy. If the changes are significant, we will provide a more prominent notice of the update (such as by posting a notice on our website’s homepage or notifying users via email, if we have your email on file).

We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information. Your continued use of our Services after any changes to this Policy constitutes your acceptance of the updated terms. If you do not agree with a change, you should stop using the Services and can request that we delete your personal information as described above.
